The Legal Position Changed in 2025–2026
Many older articles about online gambling in India focus almost entirely on the Public Gambling Act of 1867 and individual state gambling laws.
That historical framework is no longer enough to describe the current position.
The Promotion and Regulation of Online Gaming Act, 2025 — Act No. 32 of 2025 — was enacted on August 22, 2025. The Act applies throughout India and expressly states that it also applies to online money-gaming services offered within India or operated from outside India. The Act was brought into force from May 1, 2026.
The Promotion and Regulation of Online Gaming Rules, 2026 were notified on April 22, 2026 and also came into force on May 1, 2026.
What the Act Addresses
The Act distinguishes among different forms of online gaming.
Its structure provides for recognition or promotion of categories such as e-sports and online social games while creating specific prohibitions concerning online money games. The Act’s prohibition chapter contains separate provisions concerning offering online money games, advertising them and transferring funds connected with online money-gaming services.
For casino research, this is important because a conventional real-money casino generally cannot be analysed solely by asking whether its games involve skill or chance.
The newer national framework directly addresses online money gaming.
Offshore Operators Are Included
The Act expressly addresses services operated from outside India when offered within India. Its legislative text also discusses the enforcement problems created by offshore gaming services.
This is why IndiaCasinoSite does not use wording such as:
“Offshore casino = automatically legal.”
A Curaçao or Anjouan licence answers a different question:
Is this operator licensed under that foreign regulator’s framework?
It does not by itself answer:
Is real-money participation with this service authorised under Indian law?
Those are separate questions.
Online Gaming Authority of India
The 2026 Rules established the Online Gaming Authority of India, or OGAI, as an attached office of MeitY.
According to the government’s explanation of the Rules, the Authority can perform functions including determining the classification of games, maintaining relevant lists, handling complaints and appeals, issuing directions and coordinating with financial institutions and enforcement bodies.
Determining Whether a Game Is an Online Money Game
The Rules provide a determination process.
Government guidance identifies factors including:
- whether users pay fees or stakes;
- whether monetary winnings are expected;
- the operator’s revenue structure;
- whether rewards or in-game assets can be monetised outside the game.
Determinations are intended to be specific to a particular game and provider.
E-sports and Online Social Games
The national framework does not treat every online game identically.
Government materials explain that the Rules provide mechanisms for permissible e-sports and certain online social games, including registration in circumstances specified by the framework.
Online money games are treated separately.
This distinction matters when reading older content that simply categorises every online game as “gambling.”
Advertising and Promotion
The Act contains a specific prohibition concerning advertisements related to online money games.
That is particularly relevant to affiliate publishers, influencers, advertising networks and websites whose commercial model involves encouraging users to participate in real-money gambling.

Financial Facilitation
The Act also contains a separate prohibition dealing with transfer of funds connected with online money-gaming services.
Government guidance on the 2026 Rules likewise describes safeguarding the financial system and preventing banks, payment systems and financial institutions from facilitating transactions linked to prohibited online money games.
A payment option appearing on an offshore gambling website should therefore not be confused with legal approval.
User Safety Under the 2026 Rules
Government guidance describes user-safety features under the Rules including mechanisms such as age verification, time restrictions, parental controls, reporting tools, counselling support and fair-play monitoring, depending on the relevant category and regulatory process.
The Rules also establish grievance and appellate mechanisms for regulated categories of online games.
Do State Laws Still Matter?
Yes.
The national legislation does not mean every other law disappears.
Section 18 of the Act states that its provisions are not in derogation of other laws.
Depending on the particular issue, other central laws, state laws, financial rules, consumer-protection rules, taxation provisions and criminal-law provisions may still matter.
That is another reason broad claims such as “online gambling is legal everywhere in India” should be avoided.
Accessibility Does Not Equal Legality
A website may:
- load on an Indian internet connection;
- display INR;
- show UPI;
- advertise cricket;
- provide an Android application;
- offer customer support to Indian users.
None of those technical or commercial facts alone establishes legal authorisation.
